1. Introduction
Welcome to Harkitek (“we,” “our,” or “us”). Harkitek provides outsourced digital infrastructure, website management, and automated administrative services specifically designed for tradespeople. By engaging our services, you (“the Client”) agree to be bound by the following Terms and Conditions.
2. The Core Agreement: “You do the trade, we handle the admin”
Harkitek agrees to build, manage, and maintain the digital infrastructure required to generate leads, schedule jobs, and organize inquiries. The Client agrees to provide the professional trade services to their end-customers. Harkitek is strictly an administrative and technical partner and is not liable for the quality, safety, or outcome of the physical trade work performed by the Client.
3. Services Provided
Depending on your chosen package, Harkitek provides a combination of the following:
- Professional Website: Hosting, building, and maintaining a high-speed, lead-generating custom website.
- Instant Dispatch System: Routing customer inquiries directly to the Client’s device via Telegram API and custom WhatsApp links.
- CRM Database: Setting up and managing a secure cloud-based database (e.g., Google Sheets) to log and organize all customer leads.
- Automations: Configuring requested automations, such as quick-reply templates for Google Review requests.
Harkitek utilizes secure industry-standard APIs to deliver these services. We are responsible for the integration, maintenance, and uptime of these tools.
4. Fees and Payment Terms
Harkitek operates on a transparent, flat-rate model consisting of a one-time setup fee and an ongoing monthly retainer. We do not charge by the hour.
- Setup Fee: A one-time fee is required upfront to cover the bespoke build of the website, database, and dispatch API infrastructure.
- Monthly Retainer: The ongoing flat rate covers website hosting, API maintenance, unlimited minor text/image tweaks, and technical support. Payments are due monthly in advance.
- Failure to pay the monthly rate may result in the suspension of the website, database access, and lead routing automations until the balance is cleared.
5. Data Processing & Customer Leads (UK GDPR)
Because our system captures names, phone numbers, and job details from your customers, we operate under strict UK GDPR guidelines. To keep things transparent and legally compliant:
- Data Controller vs. Processor: The Client (you, the tradie) is the legal “Data Controller” of all leads generated through your website. Harkitek acts solely as the “Data Processor.”
- Ownership: All customer data collected via the Client’s website belongs strictly to the Client. Harkitek claims no ownership over your leads.
- Our Promise: Harkitek will only use this data to perform the agreed-upon services (routing the leads via Telegram and storing them securely in Google Sheets). We will never sell, mine, share, or market to your leads.
- Data Deletion: Upon cancellation of the service, Harkitek will hand over a final export of the data and permanently delete the lead database at the Client’s request.
6. Termination of Services
We do not lock tradespeople into complex, multi-year contracts. You may cancel your monthly retainer at any time with a standard 30-day written notice.
Upon termination, Harkitek will provide a full export of your customer data so you can retain your records. Websites, custom API scripts, and proprietary automation pipelines built entirely by Harkitek remain the intellectual property of Harkitek unless a separate buyout agreement is arranged.
7. Limitation of Liability
While we strive for 100% uptime, Harkitek is not liable for temporary service interruptions caused by third-party outages (e.g., Telegram, WhatsApp, Google, or hosting providers experiencing global downtime). We are also not liable for any lost revenue, missed leads, or disputes between the Client and their end-customers.
